Do You Need a Permit to Build a Deck in Mecklenburg County?

New deck framing and railing posts during construction

Short answer: for most attached decks in Mecklenburg County and surrounding jurisdictions — yes. Here's the practical version of the rules, and why skipping the permit is a bad trade.

When a permit is required

  • Any deck attached to the house generally requires a residential building permit.
  • Elevated decks — commonly anything more than 30 inches above grade — trigger guardrail and permit requirements.
  • Freestanding, low platforms under size thresholds may be exempt, but rules vary by jurisdiction (Charlotte, Huntersville, Matthews, and county areas each administer their own).

What inspectors actually check

Footing size and depth before concrete, ledger attachment and flashing, joist spans and hardware, guardrail height and baluster spacing, and stair geometry. Notice a theme: it's all structure and safety — the exact things that fail on DIY and cash-job decks.

Why unpermitted decks cost you later

Unpermitted additions surface during home sales — buyers' inspectors flag them, lenders and insurers ask questions, and you can end up retro-permitting (opening up finished work) or discounting the house. A permit that costs a few hundred dollars protects a five-figure asset.

The easy path

Have your builder pull the permit. We handle drawings, submission, and inspection scheduling for every FrameCraft deck that needs one — it's included in the project, and you never stand in a county line.
